In order to claim defence of alibi(c/f mere denial per Vasan Singh), there is a mandatory requirement that a formal notice be given to PP at least 10 days prior to trial.
Husin b silit: caution statement does not constitute such formal notice per S402A
In other wors, one cannot take cautioned stmt as formal statement in raising the defence of alibi.

formal stmt is just notice in writing per the Section...my ustanding of cautioned stmt differs but usually we dun need to explain, just bear in bind one entitled accused the defence of alibi and another not

rangapula - purpose of s402A is to prevent accused from fabricating evidence and enable police to investigate the alleged defence and interrogate the witness to be called in support of such defence prior to trial
